If you need to call a mufti and your husband says you’re not allowed to speak to a mufti, can you still call….or do you have to obey him?
Bismillahi Ta’ala
Walaikum Assalam Warahmatullah
Access to a scholar or a Mufti to resolve religious matters is an independent right of every individual. Allah has commanded in the Qur’an to ask the people of knowledge if one does not know of religious matter. This means, if the wife does not have a direct access to a scholar or a Mufti, and the husband himself is not knowledgeable in deen, then it becomes the husband’s religious duty to make such arrangements for his wife.
In such a condition, if the husband does not make such arrangement, as well as does not allow the wife to approach a Mufti to resolve her religious matters, then he will be held accountable in the court of Allah for not fulfilling the rights of the wife.
If the wife calls and connect the Mufti despite the husband not allowing it, then she will not be sinful. However, this is not entirely recommended. As a practice, any contact with Mufti from the wife should be in the knowledge of the husband, so that there is no su’ al dhan (ill thoughts) formed in the mind of the husband.
Another solution is to keep a contact with some female scholar, who can get guidance from a Mufti. Regardless of how the contact is made, the wife should be careful and wise in how she handles it. It is not a desire that this aspect turns the marriage so sour that distrust seeps into the marriage.
